PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND
KEEP A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE
Format of the Contract
These terms of sale apply to all goods supplied by A.C.T Safeguard Ltd, whose
registered office is at Vaughan House, 3 Eggleston Court, Middlesbrough, TS2
1RU, registered in England number 3645169 (the "Supplier").
No contract exists between you and A.C.T Safeguard Ltd for the sale of any
goods until A.C.T Safeguard Ltd has received and accepted your order and A.C.T
Safeguard Ltd has received payment in full (in cleared funds).
The contract is subject to your right of cancellation (see below).
A.C.T Safeguard Ltd may change these terms of sale without notice to you in
relation to future sales.
Description and Price of the Goods
The description and price of the goods you order will be available to
you at the time you place your order.
The goods are subject to availability. If on receipt of your order the goods
you have ordered are not available in stock, A.C.T Safeguard Ltd will inform
you as soon as possible and either place the item/s on backorder or refund or
re-credit you for any sum that has been paid by you or debited from your credit
card for the goods.
Every effort is made to ensure that prices shown on A.C.T Safeguard Ltd 's
website are accurate at the time you place your order. If an error is found,
A.C.T Safeguard Ltd will inform you as soon as possible and offer you the
option of reconfirming your order at the correct price, or cancelling your
order. If A.C.T Safeguard Ltd does not receive an order confirmation within 14
days of informing you of the error, the order will be cancelled automatically.
If you cancel, A.C.T Safeguard Ltd will refund or re-credit you for any sum
that has been paid by you or debited from your credit card for the goods.
In addition to the price, you may be required to pay a delivery charge for the
goods.
Payment
Payment for the goods and delivery charges can be made by any method
shown on A.C.T Safeguard Ltd 's website at the time you place your order.
Payment shall be due before the delivery date and time for payment shall be of
the essence.
There will be no delivery until cleared funds are received.
Payments shall be made by you without any deduction whether by way of set-off,
counterclaim, discount, abatement or otherwise unless you have a valid court
order requiring an amount equal to such deduction to be paid by A.C.T Safeguard
Ltd to you.
Some methods of payment may incur an additional charge by your bank
unless otherwise advised in writing these would be paid by the customer.
Prices quoted are net (exclusive of VAT) and carriage costs.
Delivery
The goods you order will be delivered to the address you give when you
place your order, except that some deliveries are not made outside the United
Kingdom.
Orders placed before 2 pm on a working day will be processed that day and will
be delivered as per the requested delivery option provided no additional
security checks are required and all stock items are available. (A working day
is any day other than weekends and bank or other public holidays.)
If delivery cannot be made to your address for reasons under A.C.T Safeguard
Ltd 's control A.C.T Safeguard Ltd will inform you as soon as possible and refund
or re-credit you for any sum that have been paid by you or debited from your
credit card for delivery.
If you deliberately fail to take delivery of the goods (otherwise than by
reason of circumstances under control of A.C.T Safeguard Ltd ) then without
prejudice to any other right or remedy available to A.C.T Safeguard Ltd , A.C.T
Safeguard Ltd may:
store the goods until actual delivery and charge you for reasonable costs
(including insurance) of storage; or
sell the goods at the best readily obtainable price and (after deducting all
reasonable storage and selling expenses) account to you for any excess over the
price you agreed to pay for the goods or charge you for any shortfall below the
price you agreed to pay for the goods.
If you fail to take delivery because you have cancelled your contract under the
Distance Selling Regulations, A.C.T Safeguard Ltd shall refund or re-credit you
within 30 days for any sum that has been paid by you or debited from your
credit card for the goods, less any expenses incurred for failed delivery.
Every effort will be made to deliver the goods as soon as possible after your
order has been accepted.
However, A.C.T Safeguard Ltd will not be liable for any loss or damage
suffered by you through reasonable or unavoidable delay in delivery. In this
case, A.C.T Safeguard Ltd will inform you as soon as possible.
Time for delivery shall not be of the essence. The goods may be delivered by
A.C.T Safeguard Ltd in advance of the quoted delivery date.
Upon receipt of your order you will be asked to sign for the goods received in
good condition. If you are unable to check the contents of the package at that
moment in time please sign for the parcel as "UNCHECKED", if the
packaging is damaged please sign as “DAMAGED”. Failure to do so may affect any
warranty claims that you make thereafter.
You have 5 working days from date of delivery to inform us of any
missing items. After this replacements cannot be guaranteed. If we deliver the
wrong item or after consulting with us the wrong item is recommended we will
replace the item within 5 working days. If an incorrect item is ordered we will
accept it back within 10 working days of delivery with a 20% restocking fee.

Safeguard Ltd will be pleased to arrange this.
Shipping Abroad
When sending good abroad the cost of delivery will depend on the weight
and dimensions of the parcel. Various methods are available, the most popular
(cost effective) being by road. Should you have any questions or wish to
arrange a pick up by your own currier (via Postal supermarket) let us know.
Risk/Title
Ownership of the goods shall not pass to you until A.C.T Safeguard Ltd
has received in full (in cash or cleared funds) all sums due to it in respect
of: the goods, and all other sums which are or which become due to A.C.T
Safeguard Ltd from you on any account.
A.C.T Safeguard Ltd shall be entitled to recover payment for the goods
notwithstanding that ownership of any of the goods has not passed from A.C.T
Safeguard Ltd .
Your Right of Cancellation
End Consumer
You have the right to cancel the contract at any time up to the end of
14 working days after you receive the goods (see below).
To exercise your right of cancellation, you must give written notice to A.C.T
Safeguard Ltd by letter or via E-mail, giving details of the goods ordered and
(where appropriate) their delivery. Notification by phone is not sufficient.
If you exercise your right of cancellation after the goods have been delivered
to you, you will be responsible for returning the goods to A.C.T Safeguard Ltd
at your own cost. The goods must be returned to the address shown below. You
must take reasonable care to ensure the goods are not damaged in the meantime
or in transit.
Once you have notified A.C.T Safeguard Ltd that you are cancelling the
contract, A.C.T Safeguard Ltd will refund or re-credit you within 14 calendars
days for any sum that has been paid by you or debited from your credit card for
the goods.
If you do not return the goods as required, A.C.T Safeguard Ltd may charge you
a sum not exceeding the direct costs of recovering the goods.
You do not have the right to cancel the contract if the order is for computer
software which has been unsealed by you, or for consumable goods which, by
their nature, cannot be returned.
Business
The distance selling regulations right to cancel does not apply to sales
between businesses.
Warranty
All goods supplied by A.C.T Safeguard Ltd are warranted free from
defects for 12 months from the date of supply (unless otherwise stated). This
warranty does not affect your statutory rights as a consumer.
This warranty does not apply to any defect in the goods arising from fair wear
and tear, wilful damage, accident, negligence by you or any third party, use
otherwise than as recommended by A.C.T Safeguard Ltd , failure to follow A.C.T
Safeguard Ltd 's instructions, or any alteration or repair carried out without
A.C.T Safeguard Ltd 's approval.
If the goods supplied to you are damaged on delivery, you should notify A.C.T
Safeguard Ltd in writing via the e-mail address or fax number shown below
within 48 Hours of delivery.
If the goods develop a fault during the 12 month warranty you should notify
A.C.T Safeguard Ltd in writing via the e-mail address or fax number shown. If
after contacting the item is deemed faulty you will be responsible for the cost
of returning the goods to us unless otherwise advised, we recommend using a
tracked service as you are responsible for the goods delivery. The goods will
then be sent for testing and replaced or repaired if faulty through fault in
equipment we will return the goods to you at our expense using standard
delivery (UK only), in most cases goods will be sent to manufacturer for this.
If the goods are not found deemed to be faulty through equipment fault you will
be advised in writing and given the opportunity for them to be returned to you
at your expense. This process will normally take around 14 days from
receipt of faulty goods. In some instances we may choose to offer a
refund rather than replace a faulty item. In some instances our suppliers (Eg Visonic / Partizan) offer a longer term warranty we will return the faulty item to them and should the item be repaired, replaced or refunded we will pass this benefit back to the installer.
Limitation of Liability
A.C.T Safeguard Ltd 's total liability in contract, tort (including
negligence or breach of statutory duty), misrepresentation, restitution or
otherwise, arising in connection with the performance or contemplated
performance of this agreement shall be limited to the price paid for the goods.
Nothing in these conditions excludes or limits the liability of A.C.T Safeguard
Ltd for death or personal injury caused by A.C.T Safeguard Ltd’s negligence or
fraudulent misrepresentation.
If you are a business customer A.C.T Safeguard Ltd shall not be liable to you
for any indirect or consequential loss or damage (whether for loss of profit,
loss of business, depletion of goodwill or otherwise), costs, expenses or other
claims for consequential compensation whatsoever (howsoever caused) which arise
out of or in connection with this agreement.
Data Protection and Business Privacy Policy
This privacy policy sets out how A.C.T Safeguard Ltd uses and protects
any information that you give A.C.T Safeguard Ltd when you use this website.
A.C.T Safeguard Ltd is committed to ensuring that your privacy is
protected. Should A.C.T Safeguard Ltd ask you to provide certain information by
which you can be identified when using this website, and then you can be
assured that it will only be used in accordance with this privacy statement.
A.C.T Safeguard Ltd may change this policy from time to time by updating
this page. You should check this page from time to time to ensure that you are
happy with any changes. This policy is effective from 24/08/2012.

details of your order and payment secure but unless A.C.T Safeguard Ltd is
negligent, A.C.T Safeguard Ltd will not be liable for unauthorised access to

Applicable Law
These terms of sale and the supply of the goods will be subject to
English law and the English courts will have jurisdiction in respect of any
dispute arising from the contract.

From time to time A.C.T Safeguard Ltd may offer special offers /
promotions that run for a period.
Promotional items not claimed within 3 months of ordering may be lost,
no alternative will be offered in such circumstances.
